1. Acceptance of Terms

By accessing or using FlyBriefed (the “Service”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

FlyBriefed provides a searchable directory of pilot-submitted checkride experiences (“gouges”) and related features for educational purposes. We may add, change, or discontinue features at any time.

3. Eligibility & Accounts

• You must be at least 13 (or the minimum age in your jurisdiction) to use the Service.
• You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• You must provide accurate information and notify us of any unauthorized use.

4. User Content & License

You retain ownership of content you submit (“User Content”). By submitting, you grant FlyBriefed a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting), display, and distribute your User Content to operate and improve the Service.

You represent and warrant that you have all rights necessary to grant this license, and that your submission does not infringe others’ rights or contain personal data you do not wish to publish.

5. User Content Guidelines

• Share only your own checkride experiences; be accurate and respectful.
• Do not post confidential testing material, answers, or content obtained in violation of policy or law.
• Do not include sensitive personal data (e.g., phone numbers, home addresses).
• No unlawful, defamatory, harassing, hateful, or infringing content.

6. Moderation & Takedown

We may (but are not obligated to) review, remove, or refuse User Content and suspend or terminate accounts that violate these Terms or applicable law. We may preserve and disclose information if required by law or to protect rights and safety.

7. Educational Disclaimer

The Service is for educational purposes only. Gouges reflect individual experiences and are not official FAA guidance. Always consult current regulations, official publications, and your instructor. FlyBriefed does not guarantee any checkride outcome.

8. Prohibited Uses

• Reverse engineering, scraping, or excessive automated access.
• Interfering with security, integrity, or availability of the Service.
• Using the Service for unlawful purposes or to violate aviation rules.
• Impersonation or misrepresentation of affiliation.

9. Intellectual Property

The Service (excluding User Content) is owned by FlyBriefed and its licensors and is protected by IP laws. No rights are granted except as expressly set out in these Terms.

10. Third-Party Services

We may integrate third-party services (e.g., hosting, analytics, email). Their terms and privacy policies govern your use of those services.

11. Copyright/DMCA

If you believe content infringes your copyrights, contact flybriefed@gmail.com with: (a) your contact info, (b) identification of the work, (c) the infringing material’s URL, (d) a statement of good-faith belief, (e) a statement under penalty of perjury that your notice is accurate and you are authorized, and (f) your physical or electronic signature. We may remove content and terminate repeat infringers.

12. Changes to the Service & Terms

We may update these Terms and the Service from time to time. If changes are material, we will provide reasonable notice. Continued use after changes becomes effective means you accept the updated Terms.

13. Warranty Disclaimer

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLYBRIEFED AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) USD $100.

15. Indemnification

You agree to defend, indemnify, and hold harmless FlyBriefed and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms or applicable law.

16. Termination

We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, the rights granted to you under these Terms will cease. Sections that by their nature should survive will survive termination (e.g., User Content license, IP, disclaimers, limits of liability, indemnity).

18. Miscellaneous

• Severability: If any provision is unenforceable, the remainder remains in effect.
• No waiver: Failure to enforce a provision is not a waiver.
• Assignment: You may not assign these Terms; we may assign as part of a reorganization or sale.
• Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control.
• Entire Agreement: These Terms and the Privacy Policy are the entire agreement between you and FlyBriefed regarding the Service.

This Privacy Policy explains how FlyBriefed (“we,” “us,” “our”) collects, uses, and shares information when you use our website and services (the “Service”).

2) Information we collect

• Account Information: Email address, password (stored using one-way encryption), and subscription status.
• Submitted Content (UGC): Checkride gouges, examiner names, airports, aircraft, outcomes, and any other information you choose to include. Gouges may be published publicly.
• Payment Information (if used later): Processed by our payment provider; we do not store full card numbers.
• Usage & Device Data: Pages viewed, search queries, links clicked, IP address, browser, device type, general location, and diagnostic logs.
• Cookies & Similar Tech: Essential cookies for the site to work; analytics cookies to understand usage (see “Cookies & analytics”).

3) How we use information

• Service delivery: Operate the directory, render pages, secure accounts, and process payments.
• Content organization: Categorize and format user-submitted gouges.
• Communication: Account notices and support; with your consent, product updates and early access emails.
• Improvement & safety: Analytics, debugging, preventing abuse/fraud, and enforcing our terms.

4) Legal bases (EEA/UK users)

• Contract: To provide the Service you request.
• Legitimate interests: Improve and secure the Service, prevent misuse.
• Consent: Optional marketing emails and non-essential cookies/analytics.
• Legal obligation: Compliance with applicable laws and lawful requests.

5) Information sharing

We do not sell personal information. We share information only with service providers (hosting, email delivery, analytics, payments), to comply with law, protect rights, or as part of a business transfer (e.g., merger or acquisition).

6) User-generated content visibility

Gouges you submit may be publicly viewable. Do not include personal data you don’t want published (e.g., phone numbers, addresses). We may moderate or remove content that violates our policies.

7) Cookies & analytics

Essential cookies run the site (security, session). Analytics cookies help us understand usage and improve features. EEA/UK users will be asked for consent for non-essential cookies. You can control cookies in your browser settings.

8) Data retention

• Account data: Kept while your account is active; deleted or anonymized within 30–90 days after closure unless retention is required by law.
• UGC (gouges): Retained until you remove it or request deletion; backups may persist for up to 90 days.
• Analytics & logs: Typically 12–18 months.
• Marketing contacts: Until you unsubscribe or after 24 months of inactivity.

9) Security

We use industry-standard measures, including HTTPS encryption in transit, secure password storage, access controls, and periodic reviews. No method is 100% secure.

10) International transfers

We may process data in countries outside your own. Where required, we use appropriate safeguards (e.g., Standard Contractual Clauses) for cross-border transfers.

11) Your rights

Depending on your location, you may have rights to access, correct, delete, and export your personal data, and to object to or restrict certain processing.

• Marketing: You can unsubscribe at any time using the link in our emails or by contacting us.
• Cookies: Manage via your browser settings; EEA/UK users can update consent via our cookie banner (when implemented).

U.S. State Privacy Rights (e.g., CA/CO/CT/VA): Residents of certain U.S. states may have additional rights, including the right to know/access, correct, delete, and opt out of targeted advertising or sale/share of personal information. We do not sell personal information. If we use targeted advertising in the future, we will provide an opt-out mechanism. To exercise rights, email flybriefed@gmail.com. We may need to verify your request and identity; you may use an authorized agent where allowed by law.

12) Children

The Service is not directed to children under 13 (or 16 where applicable). We do not knowingly collect personal data from children in those age ranges.

13) Changes to this policy

We may update this Policy from time to time. We will change the “Last updated” date above and, if changes are material, provide additional notice.
